I agree that Loansville may verify my name, address, phone number, and other account details with information about myself held by third party sources including TransUnion, and my mobile service provider in order to verify my identity and help protect myself and Loansville against potential fraud, such as when someone other than myself is trying to open an account with Loansville without my permission, and I provide consent for such third party sources to disclose and/or compare my information for this purpose. My personal information received from these specific sources will not be used by Loansville or shared with any third parties for any other purpose.


I understand and agree that Loansville may collect, use and/or disclose My Personal Information for any or all of the purposes disclosed in the Personal Information Consents and Representations Agreements, and I authorize Loansville to access my credit report (or such other similar report), and call/message a phone number or send an email to an address provided by me, for those purposes.


I agree to the Personal Information Consents and Representations Agreement.


I may periodically provide to Loansville Inc., and/or its franchises, agents, representatives, affiliates, successors, and assigns (collectively “Loansville”), and Loansville may periodically collect from or about me, certain personal information and records which may include among other things: name; current home and work addresses (including email addresses); previous addresses; current phone numbers (home, work, or other); physical descriptors and any such other identifiers (including, but not limited to, date of birth and Social Insurance Number); credit history, including credit reports, consumer reports, personal reports, or such other similar reports; next of kin; personal references; source and amount of income; financial information necessary to verify my creditworthiness; transactions with Loansville; and agreements and other documents pertaining to transactions with Loansville (“My Personal Information”).


I understand that Loansville collects, and as permissible by law, uses and/or discloses My Personal Information for any or all of the following purposes: (1) to obtain credit information and credit reports (or such other similar reports) on me from credit reporting agencies (or such other similar entity) to assess credit history and credit worthiness and to confirm accuracy of information provided by me;(2) to confirm my identity;(3) to meet legal and regulatory requirements;(4) to confirm details of my employment;(5) to collect a debt that may become owed to Loansville;(6) to extract certain information for the purpose of generating statistics for its internal purposes;(7) to record, track and respond to my feedback and complaints; and(8) to evaluate, complete, facilitate, or otherwise as part of any business transaction or prospective business transaction involving Loansville, which may include but are not limited to the purchase or sale of the whole, part, or any assets of Loansville, the making of a loan or other financing to Loansville, and the creation of a charge or taking of security interest in or on any assets of Loansville (generally “Business Transaction”), and as may be required to be disclosed to, or collected and used by, third parties from time to time for the purposes of same; and (9) to facilitate and allow verification of my transactions, including but not limited to origination, payment, and charge-off of my loan, with Loansville, by third parties which may be located in the United States of America (“USA”) and Europe, and as may be required from time to time as part of any Business Transaction involving Loansville. I further understand that Loansville will share and store My Personal Information and other transaction information with affiliated companies of Loansville located in the USA for the purposes listed above and that Loansville will keep track of my feedback and complaints utilizing a third party service provider whose servers are located in Europe and I agree and authorize to such collection, use and disclosure.


Further, I acknowledge and agree that by using the services of Loansville, I am consenting to Loansville and the third parties referenced above collecting, and as permissible by law, using, and disclosing My Personal Information for these purposes. Without limiting any of the foregoing or any other provision in this Agreement, or the provisions of any other provisions between Loansville and I, I further and specifically consent to and authorize Loansville to: (a) verify the accuracy of the information contained in my application by, among other actions, checking my credit report (or such other similar reports) before entering into any transaction with Loansville for the purposes identified above; (b) to check my credit report (or such other similar reports) for any legitimate business need in connection with a transaction between me and Loansville; (c) submit my application to a consumer reporting agency (or such other similar entity); (d) call my employer to confirm employment, (e) contact me for any reason related to my loan application, my loan, and Loansville’s services and promotions, and (f) obtain my bank account information. If I obtain one or more loan transactions from Loansville, I authorize Loansville to service my transactions by obtaining information about my whereabouts from the contact persons I have listed.


I represent and agree that My Personal Information provided to Loansville is accurate and complete. If there is a change in My Personal Information, I agree to advise Loansville.


I further agree and authorize Loansville to utilize My Personal Information to offer specialized services or to assess whether such services may be available or of interest to me, as permissible by law. I further agree and authorize that My Personal Information may be shared with third parties for this purpose. Upon giving reasonable notice to Loansville, I understand that I may withdraw my consent to Loansville using My Personal Information or providing to third parties for these purposes (subject to legal or contractual limitations).

I understand that cookies are small data files placed on my computer by a website. They may store and transmit information to websites that I visit. I understand that www.loansville.ca uses cookies on its website to:

If I reside in the Province of Manitoba, any consent that I give in this Personal Information Consents and Representations Agreement also constitutes consent to a “personal investigation” as defined in The Personal Investigation Act, as applicable. This signed Agreement forms written consent to a personal investigation by me.


This Agreement is effective from the time I sign this Agreement, irrespective of whether my interactions, dealings, transactions, or otherwise with Loansville result in a loan agreement, until such time as I withdraw my agreement and consent to this Agreement.

MOBILE PRIVACY POLICY

Applicability

This policy governs your use of a software application ("Application") on a mobile device provided by Loansville Financial Services or any of its affiliates ("we" or "us"). The Application allows you to transmit and deposit checks and other financial instruments using compatible and supported mobile phones and/or other compatible and supported wireless devices or network devices under your control (the "Services").


What information does the Application obtain and how is it used?


User Provided Information

The Application obtains the information you provide when you download and register the Application. Registration with us is mandatory in order to be able to use the basic features of the Application. When you register with us and use the Application, you generally provide: (a) your name, email address, birth date, user name, password and other registration information; (b) transaction-related information, such as when you conduct transactions, or download or use applications from us, which can include phone number, birth date, and/or social security number; (c) information you provide us, including phone number or other contact information, when you contact us for help; (d) an image of checks and other financial instruments you send to us that may contain personal and financial account information, (e) your debit card or other payment card information; and (f) any other information, including income, you enter into our system when using the Application. We may also use the information you provided us to contact you from time to time to provide you with important information, required notices, and marketing promotions only where permitted by law.


Automatically Collected Information

In addition, the Application may collect certain information automatically, such as the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.


Does the Application collect precise real time location information of the device?

This application collects precise information about the location of your device in order to assist in making sure the transaction complies with applicable laws and regulations.


Do third parties see and/or have access to information obtained by the Application and may I limit this sharing of information?

Our general privacy policy describes the information we may share and your rights to limit that sharing. Note that we do not share information with third parties to market to you.


Automatic Data Collection

We may use your information to conduct our own analytics to help us understand how the Application is being used, such as the frequency and duration of usage. The Application does not track, and does not allow any third-party to track, an individual consumer’s online activities over time or across third-party Web sites or online services. Accordingly, the Application does not respond to a “do not track” signal or similar mechanism. The Application collects only the personal information provided voluntarily from the consumer and submitted to us.


Managing Your Information

We will retain your data for as long as you use the Application and for a reasonable time thereafter.
